Enrollment and Eligibility By applying for FOSSSILPOWER Affiliate Program, you represent that you are at least 18 years of age. We reserve the right to review and approve or reject any application at our sole discretion. 2. Relationship of Parties You are an independent contractor. Nothing in this agreement creates a partnership, joint venture, agency, or employment relationship between you and FOSSILPOWER . You have no authority to make or accept any offers or representations on our behalf. 3. Qualified Referrals and Commissions • Qualified Referral: A sale is considered "qualified" when a customer clicks your unique affiliate link, completes a purchase, and the payment is successfully processed. • Commission Rate: You will receive 15% of the net sale price (excluding taxes, shipping, and returns). • Cookie Duration: Our tracking cookies last for 30 days. If a customer clears their cookies or uses a different browser, the sale may not be tracked. • Exclusions: Commissions are not paid on self-purchases, fraudulent transactions, or cancelled/refunded orders. 4. Payment Terms • Minimum Payout: N • Payment Schedule: Payouts are issued 1st of each month for commissions earned during the previous month. • Method: Payments will be made via PayPal or Bank Transfer. • You are responsible for any transaction fees and taxes. 5. Promotional Guidelines & Restrictions To maintain the integrity of our brand, affiliates must adhere to the following: • Truthful Advertising: You must not make false or misleading claims about our products or services. • Disclosures: You must clearly disclose your affiliate relationship in accordance with FTC guidelines (e.g., using hashtags like #ad or #affiliate). • Prohibited Traffic: You may not use "spam" (unsolicited email), pop-ups, or aggressive "bidding" on our branded keywords in search engine marketing. • Content Standards: Your website/social media must not contain defamatory, obscene, or illegal content. 6. Intellectual Property We grant you a non-exclusive, non-transferable, revocable right to use our logos, trade names, and provided creative assets solely for the purpose of promoting our products under this program. You may not alter our assets without prior written consent. 7. Termination Either party may terminate this agreement at any time, with or without cause, by giving the other party written notice. Upon termination, you must immediately remove all affiliate links and branded assets from your platforms. Any commissions earned through fraudulent activity will be forfeited. 8. Limitation of Liability FOSSILPOWER will not be liable for indirect, special, or consequential damages arising in connection with this program, even if we have been advised of the possibility of such damages. Our aggregate liability will not exceed the total commissions paid to you under this agreement.
